Regular Village Board Meeting March 15, 2010

The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on March 15th, 2010 was called to order by Mayor Thomas G. Coates at 7:00 P.M.

 

            PRESENT:      Thomas G. Coates, Mayor

                                    Megan Grenier, Trustee

                                    Timothy A. Lane, Trustee

                                    Ronald H. Miller, Trustee

                                                William T. Smith, Jr., Clerk-Treasurer

                                                Paul Reuss, Exec Asst to the Mayor

 

            ABSENT:       Mark Lansing, Trustee

                                    Stephen Rehfuss, Village Attorney

                                                           

            Also attending: Bill Garvey, Joe Bianchine, and Paul Cooney

 

            The Mayor led the Pledge of Allegiance.

 

            Joseph Bianchine of ABD Engineers, representing Menand Mobil discussed with the Board the changes they requested the last time he was here.  After which he answered all questions.  Trustee Lane moved seconded by Trustee Miller a resolution for the addition to the Mobil Building.

            Resident Paul Cooney discussed the possible use of the state contract for paving and the good experience he had with it while working for the county.  Paul stated he used the State Contract as much as possible and that the contractors on it are the ones you want.

 

            A motion was made by Trustee Lane seconded by Trustee Miller to accept the minutes of the March 1st, 2010 meeting as amended.

            A motion was made by Trustee Lane seconded by Trustee Grenier to approve payment for the following:

           

            WARRANT #20

            The Clerk advised the Board that he had received the annual contract for use of the Police Range from the Town of Colonie and that a motion authorizing the Mayor to sign it was required.  Trustee Lane moved seconded by Trustee Miller a resolution authorizing the Mayor to sign the contract with the Town of Colonie for use of the Police Range.

            The Clerk led a discussion concerning paving Bridge Road and Sage Court and whether we should go out to BID.  After which Trustee Lane moved seconded by Trustee Grenier a resolution authorizing the Clerk to use the state contract to have the streets paved.

            Trustee Lane moved seconded by Trustee Miller a resolution approving proposed Local Law #1, 2010 Amending Chapter 169-44 relating to fees by the Village Zoning Board of Appeals.

 

A LOCAL LAW OF THE VILLAGE OF MENANDS

AMENDING ARTICLE XIII TO ADD SECTION 169-44 RELATING TO

FEES BY THE VILLAGE ZONING BOARD OF APPEALS

 

Be it enacted by the Board of Trustees of the Village of Menands as follows:

 

            SECTION 1.  Article XIII is amended by adding Section 169-44 “FEES” to the Code of the Village of Menands, which added section shall read as follows:

           

            “169-44           FEES

 

            The Zoning Board of Appeals shall charge those fees determined by the Village Board of             Trustees by resolution, which fees may be amended from time to time by resolution.”

 

            SECTION 2.  This Local Law shall take effect immediately upon its adoption and filing pursuant to the requirements of the Municipal Home Rule Law.

            Trustee Miller moved seconded by Trustee Grenier a resolution approving Local Law # 2, 2010 Amending Section 172(B)(5) relating to Site Plan Fees.

 

A LOCAL LAW OF THE VILLAGE OF MENANDS

AMENDING SECTION A172-2(B)(5) RELATING TO

SITE PLAN FEES

 

Be it enacted by the Board of Trustees of the Village of Menands as follows:

 

            SECTION 1.  Section A172-2(B)(5) of the Code of the Village of Menands is amended to read as follows:

 

            (5)        An application for preliminary site plan review and approval shall be accompanied

                        by a fee, as established by resolution of the Village Board of Trustees, which fees

                        may be amended from time to time by resolution..

 

            SECTION 2.  This Local Law shall take effect immediately upon its adoption and filing pursuant to the requirements of the Municipal Home Rule Law.

            The Clerk updated the Board on the tentative schedule for the Wards Lane Sanitary Sewer Line Relining Project.  Also about the upcoming NYCOM Main Street Economic Development Workshops.

 

            Mayor Coates discussed a request from NYCOM to write to our legislative representatives concerning the proposed reduction in AIM Funding and other topics, after which Trustee Lane moved seconded by Trustee Miller a resolution authorizing the Mayor to send a letter in support of overturning the cuts and supporting an increase in the Gross Receipts Tax.

            There was a discussion concerning getting sponsors for the concerts in the park, Trustee Grenier reminded everyone that the businesses and residents of the Village are also asked to donate to the other organizations in the Village like the Fire Department, PBA, Rotary, Scouts, and the churches so we should be careful when requesting donations.

 

            Trustee Lane introduced a proposed Local Law Amending Chapter 30 of the Village Code pertaining to the Planning Board and Environmental Quality review powers and certain Sections of Chapters 140, 148, 172, and 173 pertaining to Planning Boards.  After a discussion a Public Hearing was to be scheduled for April 5th, 2010.

 

            Trustee Lane introduced a proposed Local Law Amending Chapter 82 of the Village Code pertaining to Garbage, Rubbish and Recycling adding language about Dumpster Enclosures.  The Clerk will schedule a Public Hearing on April 5th, 2010.

 

            Trustee Lane moved seconded by Trustee Miller a resolution approving Proposed Local Law #1, 2010 amending Chapter 169-44 relating to fees by the Village Zoning Board of Appeals.

            A public hearing on the Preliminary Budget was scheduled for Monday, April 12th, 2010 at 6:30 P.M.  The Clerk was asked to have sufficient copies of the Preliminary Budget available for the public hearing.

 

            At 7:48 P.M. Trustee Grenier made a motion seconded by Trustee Lane to enter into Executive Session for a personnel matter.
