        The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on July 18, 2005, was called to order by Mayor John W. Bishop, Jr. at 7:00 P.M.

        PRESENT:        John W. Bishop, Jr., Mayor
                        Meg Grenier, Trustee
                        Timothy A. Lane, Trustee
                        Ronald H. Miller, Trustee
                                William T. Smith, Jr., Clerk-Treasurer
                                John T. Stangle, Jr., Exec. Asst. to Mayor
                                Stephen Rehfuss, Village Attorney

        ABSENT: John F. Hagmann, Trustee

        Also attending: Residents Bill Garvey, Paul Cooney, Jeanne Rutherford, Paul Vallani, Dianne MacFarland.

        The Mayor led the Pledge of Allegiance.

        Resident Paul Vallani from Clifford Road discussed people putting their garbage out for collection prior than the time allowed, and would like to see a law with fines and have it enforced.  The Mayor stated the Board is working on a law to address that very situation among other things.

        Paul Cooney representing Boswell led a discussion concerning the paving and drainage work for Brookside Avenue, Lyons Avenue and Menand Road west of the railroad tracks.   The Mayor, Paul, Jim Sheedy of Boswell and DPW Tim Boyd reviewed the areas to be done for Lyons Avenue.  After the discussion Trustee Lane offered the following motion, seconded by Trustee Miller, authorizing Boswell Engineering to continue with the project and develop cost estimates for the Board to review.

        A motion was made by Trustee Lane, seconded by Trustee Grenier, to accept the minutes of the July 5, 2003 meeting.

        A motion was made by Trustee Lane, seconded by Trustee Grenier, to approve payment for the following:

        Trustee Lane offered, seconded by Trustee Miller, a resolution to pay the Clerk-Treasurer's annual dues of $35.00 to the New York State Assoc. of Finance Officers.

        The Clerk led a discussion concerning the air conditions the Village purchased last year, after which Trustee Lane offered, seconded by Trustee Miller a motion declaring them surplus and authorizing the Clerk to offer them to either the Senior Citizens or Village Employees based upon sealed bids with the highest bidders being authorized to purchase the air conditioners.

        The Clerk advised the Board that Police Chief O’Brien would like to have 937- the 2003 Crown Victoria declared surplus so it can be sold, a new police car is on order and is expected to arrive soon.  After which Trustee Miller moved, seconded by Trustee Grenier a motion declaring the “2003 Crown Victoria” VIN # 2FAFP71W03X132611 as surplus and authorizing the Clerk to sell it to the highest bidder.

        The Clerk advised the Board that he received a letter from Assemblymen Bob Reilly advising the Clerk that the Parks Grant for $5,000.00 had been approved.  The Clerk also gave information for the NYS Office Parks & Recreation to Trustee Miller for the grant.

        The Clerk led a discussion concerning the finish work at Ganser Smith Park and what should be completed before final payment to the contractor.

        The Mayor reviewed correspondence he received from the Mohawk-Hudson River Humane Society and after a discussion Trustee Lane offered, seconded by Trustee Miller a motion authorizing the Mayor to sign the following Proclamation:

PROCLAMATION

NATIONAL HOMELESS ANIMALS’ DAY ®

August 20, 2005

WHEREAS,                the overpopulation of our nation’s most popular animals, dogs and                               cats, results in the killing of millions of dogs, cats, kittens and                             puppies each year in shelters across the United States, and

WHEREAS,                the only reason for taking these healthy, adoptable innocent                            animals’ lives is due to the fact that there are too many cats and                              dogs born as there are families willing to adopt them, and

WHEREAS,                the taking of the innocent victims’ lives forever leaves its mark on                            the caring shelter personnel who must perform the mass killing of                               cats and dogs each day to make room for the new arrivals, and

WHEREAS,                the dog and cat overpopulation crisis can readily be solved, first by
                        having dogs and cats spayed and neutered before their first littler                             and secondly by adopting a dog or cat from you local animal                             shelter, and
                        
WHEREAS,                the irresponsible dog and cat owners who do not have their pets                                 spayed or neutered are the ones accountable to the taxpayers in the                             country, for the millions of dollars spent each year on killing                                  unwanted animals they are responsible for bringing into this world,                             and

WHEREAS,                humans domesticated dogs and cats, they depend on us, therefore,                                it is our obligation to provide responsible, humane care for them                               throughout their life, and

NOW, THEREFORE, I, John W. Bishop, Jr.

MAYOR OF Village of Menands

Proclaim August 20, 2005 as NATIONAL HOMELESS ANIMALS’ DAY.

FURTHER,                I call upon all dog and cat owners to accept responsibility for the                             care of their dogs and cats, including having them spayed or                            neutered to prevent the birth of animals destined to be homeless,                               unwanted and killed.

        The Mayor reviewed with the Board the changes to the DPW Contract with the Teamsters after which Trustee Lane offered, seconded by Trustee Grenier a motion to accept the memorandum of the Tentative Agreement of the DPW Contract, and to have Bob Hite incorporate the changes into the current agreement.

        The Mayor advised the Board that the Village was out bid for the fire chiefs vehicle offered by S.W. Pitts Hose Company of Latham.

        The Board gave their Liaison Reports:

                Trustee Lane    - DPW, Beautification, Gardening
                Mayor Bishop    - Building Dept., John Stangle and Administration, Police
                Trustee Miller   - Seniors
                Trustee Grenier - Fire Co.; Youth

        Mayor Bishop also thanked the fire company for their assistance when his home was flooded.

        Trustee Miller advised the Board to get comments on the report from the graduate student to him.

        A motion was made by Trustee Lane, seconded by Trustee Grenier to adjourn.
