The regular semi-monthly meeting of the Board of Trustees of the Village of Menands held on June 16th, 2008 and called to order by Mayor Thomas G. Coates at 7:00 P.M.

The Mayor led the Pledge of Allegiance.
Paul Cooney suggested that the RFQ that was recently sent out should probably be separated into two (2) one for Engineering Design and one for Construction Inspection, a discussion followed and Mr. Cooney was reminded that there is a Bidders Conference scheduled for Wednesday the 18th at 10:00 A.M.
Resident Bill Garvey voiced his objection that village residents will be required to pay for the Town of Colonie deficit.
Resident John Stangle requested that the Village be diligent into the review of the tax rate the Town of Colonie charges to the village residents, as it has gone up since the highway tax was instituted by the Town in 2005.
A motion was made by Trustee Lansing seconded by Trustee Lane to accept the minutes of the June 2nd, 2008 meeting.

TRAINING RESOLUTION
WHEREAS, Village Law Sections 7-712 and 7-718, provides that effective January 1, 2007, all planning board and zoning board of appeals members in New York State, as well as alternate members of those boards, must complete a minimum of four hours of training each year; and
WHEREAS, the above sections of state law provide that a planning board or zoning board of appeals member shall not be eligible for reappointment to such board if they have not completed the training required by law; and
WHEREAS, the above sections of state law provide that the legislative body of the village specifies which activities qualify as training to satisfy the state requirements; and
NOW, THEREFORE, be it
RESOLVED, that the following list of agencies, commissions, associations, universities, and other organizations are approved to provide training to meet the state requirements when the training they provide pertains to municipal planning, zoning, community design, environmental issues, economic development, and local government functions and practices;
1) the NYS Department of State; Department of Agriculture and Markets; Office of the State Comptroller, Department of Health; Department of Transportation; Department of Environmental Conservation; Office of Parks, Recreation, and Historic Preservation; Hudson River Valley Greenway; and
2) The New York State Association of Towns, the New York Conference of Mayors, the New York State Association of Counties; the New York Planning Federation, the American Planning Association, the Upstate New York Chapter of the American Planning Association and it sections, and the Metro New York Chapter of the American Planning Association and its sections; and
3) The Capital District Regional Planning Commission, Central New York Regional Planning and Development Board, Herkimer-Oneida Counties Comprehensive Planning Program, Lake Champlain-Lake George Regional Planning Board, Long Island Regional Planning Board, Southern Tier Central Regional Planning and Development Board, Southern Tier East Regional Planning Development Board, Southern Tier West Regional Planning and Development Board, Genesee-Finger Lakes Regional Planning Council, Hudson Valley Regional Council, Tug Hill Commission, and Adirondack Park Agency; and
4) The Albany County Planning Department(s); and Albany County Soil and Water Conservation Districts; and
5) The Albany Law School Governmental Law Center and Institute for Legal Studies, Pace Law School, Cornell University and its Cooperative Extension; and
6) On-line planning and zoning training programs offered by the New York Municipal Insurance Reciprocal, Pace University and Land Use Law Center, and the Lincoln Institute of Land Use Policy;
AND LET IT FURTHER be
RESOLVED, that other training activities may be approved on a case-by-case basis by the Village Board of Trustees upon the request of a planning board or zoning board of appeals member; and be it further
RESOLVED, that any new member appointed to fill the last six (6) months of a term shall not be required to have attended training to be reappointed to a first full term, but must thereafter comply with the municipal training policy as provided elsewhere herein; and be it further
RESOLVED, that training received by a planning board member or zoning board of appeals member in excess of four hours in any one year may be carried over by the member into succeeding years; and be it further RESOLVED, that the Village Clerk shall create and maintain a system of tracking the training individual members complete annually; and such information shall be presented to the appointing authority prior to considering a member for reappointment.
AND LET IT FURTHER BE RESOLVED that training obtained by a planning board or zoning board member in the calendar year 2008 will be accepted.
A motion was made by Trustee Lane seconded by Trustee Miller to adopt the above resolution on training for planning board and zoning board of appeals members.

The Clerk advised the Board that due to the length of time to receive a new flow meter for the one that was hit by lightning at the Ward’s Pump Station in October of last year he would need to transfer $10,600.00 from the Water Fund Unappropriated to account F.8340.0427 Maintenance of Controls. The new flow meter has been received and installed in this fiscal year; therefore, the insurance money for damages was rolled into the unappropriated funds at the end of the fiscal year. After a discussion Trustee Miller moved seconded by Trustee Grenier a motion authorizing the Clerk – Treasurer to transfer $10,600 from the Water Fund Unappropriated Fund Balance to F.8340.0427 Maintenance of Controls.

The Clerk led a discussion on the bids for a new pick-up truck for the Water/Public Works Department. The following bids were received:

After which Trustee Lansing moved seconded by Trustee Miller a motion to accept the alternative bid from Latham Ford as it is available for immediate delivery.

Chief Primo and Assistant Chief Handerhan presented the Board with information on the requirements for training and use of the boat that is in Village Storage for the Fire Company. They have applied for a grant so that costs to the Village would be nothing or very little. Several questions were asked and discussed, after which the Board stated they will get their questions to the Clerk who will forward them to the Chief. It is expected that they will be able to report back at the July 21st Board Meeting.
Trustee Miller advised the Board that the RFQ for infrastructure had been sent and that the review team is set except that one member had to bow out due to possible conflict of interest, so another person is needed, after a discussion the Clerk was requested to ask Rich Lyons of the Albany County Sewer District if he would serve.
Trustee Lansing led a discussion concerning the changing of the date of Village Elections to the 3rd Tuesday in June vs the current date of the 3rd Tuesday in March.
Trustee Miller announced that Jayne Bolt of Glenwood Road was the winner of the Rotary Scholarship this year.
At 8:54 P.M. a motion was made by Trustee Lane seconded by Trustee Miller to enter into Executive Session.
